This privacy notice (“Privacy Notice”) governs how we, MYYSHOP VIP TECHNOLOGY HONG KONG LIMITED.  (“MS”, “we”, “our” or “MyyShop”)use, collect and store information pertaining to you (“User”, “you”), amongst other, in the following use cases: (i) When you browse, visit, sign up/login and make use of our website https://www.myyshop.com (“Website”) ; (ii) When you sign up as a user; (iii) When you provide us with your Personal Data via/through any of the forms made available by us or when you correspond with us; (iv) When you request a demo, show interest in our Startup plan or download our free reports; (vi) When an organization with which you are associated (an “Organization”) signs up to use our platform (“Platform”) in which case we may receive Personal Data about you in connection with our provision of the Platform to your Organization (however, note that this Privacy Notice does not apply where your Organization is the data controller or we have a data processing agreement in place with your Organization which governs our obligations as data processor); (vii) when you apply for a job with us; and/or (viii) When we use the personal data of the employees of our vendors, service providers and suppliers.

We greatly respect your privacy. Please read this Privacy Notice carefully, so you can fully understand our practices in relation to Personal Data. Please note that this is a master privacy notice and some of its provisions only apply to individuals in certain jurisdictions. “Personal Data” or “Personal Information” means any information that can be used, alone or together with other data, to uniquely identify any living human being. If you provide us with personal information of other third parties, please ensure that you have obtained full authorization from the third parties.

The security of your personal information is very important to us and we value your trust highly.   1. 1.1 When you browse or visit our website  https://www.myyshop.com(“Website”):  
    We collect navigational information including information about your computer and your visits to our Website such as your IP address, geographical location, browser type, referral source, length of visit and pages viewed, information about your computer hardware and software, internet service provider (ISP), the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, clickstream data, access times and referring website addresses and log files. Our Website also uses cookies, analytic tools and tracking technologies.
    We use the above information to provide and improve our Website and its features, and analytics.
    Without this information, we cannot provide our Website efficiently.

  2. 1.2 Cookies and Other Computer Information

    We use it to provide you with the requested service, document or feature in question and for internal operations (such as bug fixing, analytics, R&D, or generation of statistics).
    Legal basis: legitimate interest and, in certain contexts, consent or pre-contractual discussions (i.e. steps at your request prior to entering into a contract).
    Without this information, we cannot process your queries, provide a demo or share our free reports with you.

  4. 1.4 When you sign up as a “creator”:
    We collect information that you choose to provide or share with us, including contact information, such as your name, phone number, e-mail address, password, data required for real-name authentication, credentials, performance information, cards, offer, expense billing information, third-party platform social accounts and campaign data.
    To provide you with services such as third-party platform authorized login, creator level evaluation, or content management, we may require you to provide or authorize third-party platforms to provide us with your third-party platform account information, service usage information, and other information as prompted on the authorization page. We will verify the legality of the source of personal information in accordance with our agreements with third parties and use such personal information in compliance with relevant laws and regulations. Based on this, you authorize us to recommend commercial tasks to you using your third-party platform account information, follower count, content type, view count, and other data, either manually or automatically. You may choose to accept or reject commercial tasks, but consecutive rejections may result in a reduction of your recommendation priority. If you fail to provide the required link or the link is invalid within the specified timeframe after accepting a commercial task, we may take measures such as lowering your recommendation priority.
    We use this information to communicate with you, provide our platform to you, manage your account, real-name authentication required for payment settlement, third-party account authorization login, creator qualification assessment, help you fulfill contractual agreements, disclose to merchant that they are matching you with business orders, and settle payments, operate and improve our Website and Platform, provide support, send you requested materials, internal operations (such as bug fixing, analytics, R&D, statistics), security and fraud detection purposes.
    Legal basis: depending on the context, legitimate interest, consent (e.g. to receive certain messages or communications), pre-contractual discussions (i.e. steps at your request prior to entering into a contract), performance of a contract, or as required by applicable law.
    Note that some of your Personal Data may also be viewed by other users of the Platform. In addition, you authorize us to form a judgment about your account level based on your third-party platform social account and activity information (including the number of followers, type of work, number of broadcasts) and other data, and to recommend to you opportunity manually/automatedly, etc. You have the right to reject our decisions made only through automated decision-making. Such automated decision-making may significantly affect your legitimate rights and interests, and you have the right to ask us for clarification through the contact information agreed in this Policy, and the right to reject our decision-making only through automated decision-making, and we will provide you with appropriate remedies to protect your legitimate rights, such as explaining the logic of the automated decision-making and its relevant impact on you, or introducing manual audits to double-check the correctness of the results of the automated decision-making.     We collect information that you choose to provide or share with us, including contact information such as your name, phone number, email address, passwords, company or shop information, credentials, performance information, card information, amount information.
    We use this information to communicate with you, to provide you with our Platform, to administer your account, to manage opportunity, to help you fulfill contractual agreements, to settle payments, to operate and improve our Website and Platform, to provide support, to provide you with materials needed to send you, for internal operations (e.g., bug fixes, analytics, research and development, statistics), security and fraud detection purposes.Legal basis: depending on the context, legitimate interest, consent (e.g. to receive certain messages or communications), pre-contractual discussions (i.e. steps at your request prior to entering into a contract), performance of a contract, or as required by applicable law.

  6. 1.6 When you sign up as a user and use MyyShop-related services:
    We collect personal information from Users who wish to use any of the MyyShop Services, including but not limited to the MyyShop Trading Platform. To use these services, you must provide your e-mail address, cell phone number and password or create an account with MyyShop.
    When you make a transaction with MyyShop, we collect your name, country, city, card information, payment information, phone number, shipping information, transaction history, and order item information.
    We use this information to communicate with you, provide our platform to you, help you fulfill your contractual agreements, manage your account, suggest valuable and distinctive items to you, respond to your customer service inquiries or requests, operate and improve our Website and Platform, provide support, send you requested materials, internal operations (such as bug fixing, analytics, R&D, statistics), security and fraud detection purposes.
    Legal basis: depending on the context, legitimate interest, consent (e.g. to receive certain messages or communications), pre-contractual discussions (i.e. steps at your request prior to entering into a contract), performance of a contract, or as required by applicable law.
    Note that some of your Personal Data may also be viewed by other users of the Platform.

  7. 1.7 When an organization with which you are associated (an “Organization”) signs up to use our platform (“Platform”):
    We collect signup/login data, user name, password. We also collect notes that Organization users write on the Platform about Creators.• Note that this Privacy Notice does not apply where your Organization is the data controller or we have a data processing agreement in place with your Organization, which governs our obligations as a data processor.
    We use this information to communicate with you, provide our Platform and our services to you, manage your account, operate and improve our Platform, provide support, send you requested materials, internal operations (such as bug fixing, analytics, R&D, statistics), security and fraud detection purposes.
    Legal basis: depending on the context, legitimate interest (e.g. fraud detection), performance of a contract (e.g. our terms of use) , or as required by applicable law. Note that in some cases a data processing agreement with the Organization governs and applies to the use of this data. Without this information, we cannot communicate with you, provide our platform and its features or improve our service offering.

  8. 1.8 We also collect contact details of the employees and staff of our suppliers, service providers and vendors. This information is used to communicate with them and perform the relevant agreements. The legal basis is either the legitimate interest or performance of a contract (e.g. the relevant agreement with the supplier, service provider or vendor). Without this information, we cannot communicate with them.
    When you submit any information on the Site during your use or access, including, but not limited to, information on the MyyShop blog, the rating system, or the product catalog, you are deemed to have given your permission to MyyShop to publish such information, and MyyShop and the Site hereby enjoy an irrevocable, perpetual, worldwide and royalty-free, sub-licensable license to use all information provided by such user to exercise the copyright, compilation, database and publicity rights any user has in such material or information, in any media form.
    Finally, please note that some of the abovementioned Personal Data will be used for detecting, taking steps to prevent, and prosecute of fraud or other illegal activity, to identify and repair errors, to conduct audits, and for security purposes. Personal Data may also be used to comply with applicable laws, with investigations performed by the relevant authorities, for law enforcement purposes, and/or to exercise or defend legal claims. In certain cases, we may or will anonymize or de-identify your Personal Data and further use it for internal and external purposes, including, without limitation, to improve the services and for research purposes. “Anonymous Information” means information which does not enable identification of an individual user, such as aggregated information about the use of our services, or de-identified information. To the maximum extent permitted by law, we may use Anonymous Information and/or disclose it to third parties without restrictions (for example, in order to improve our services and enhance your experience with them).
    Please note that in the absence of special settings or statements, the content and information you actively provide, including your Personal Information upload or publish on the Application may be publicly accessed and used by third parties. We will try our best to protect your Personal Information, but we cannot completely exclude the risk of your Personal Information being leaked to the public domain. Please be cautious and careful when considering whether to provide, upload, share or publicly disclose the relevant information on the Application.
    In addition to the above, when we plan to use information for other purposes not specified in this Privacy Policy, we will obtain your explicit consent in advance separately.
    In some jurisdictions, certain types of Personal Information, such as information about your race, religious, political or philosophical views and sexual orientation, are characterized as Personal Sensitive Information and are subject to stricter regulation than other types of Personal Information. We do not require you to provide such Personal Sensitive Information to use the services we provide. By posting or communicating any such Personal Sensitive Information in the Application, you provide your consent to such information being available within the Application.

2. HOW WE PROTECT AND STORE YOUR PERSONAL DATA

  1. 2.1 Security. We have implemented appropriate technical, organizational and security measures designed to protect your Personal Data. However, please note that we cannot guarantee that the information will not be compromised as a result of unauthorized penetration to our servers. As the security of information depends in part on the security of the computer, device or network you use to communicate with us and the security you use to protect your user IDs and passwords, please make sure to take appropriate measures to protect this information.

  2. 2.2 Retention of your Personal Data.
    We store and retain data for as long as we need it (amongst other, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements). In some circumstances we retain your Personal Data as follows: (i) where we are required to do so in accordance with legal, regulatory, tax or accounting requirements, (ii) for us to have an accurate record of your dealings with us in the event of any complaints or challenges, (iii) if we reasonably believe there is a prospect of litigation relating to your Personal Data or dealings,or (iv) you agree to a longer storage period.
    Should your account be terminated by you or us for any reason, we will (subject to the above paragraph) take steps to ensure that your personal data is no longer available through our services, or otherwise used by us, within a reasonable period of time (subject to technical limitations) after such account termination.
    We offer our products and/or services globally, which means that with your prior authorized consent (including consent to this Privacy Policy), the personal information that we collect may, as appropriate, be transferred to, and stored at, a destination outside the country you are located (e.g. we store merchants' data in Hong Kong and creators' data in the US). Whenever we transfer your personal information in this way, we will take steps which are reasonably necessary to ensure that adequate safeguards are in place to protect your personal information and to make sure it is treated securely and in accordance with this Privacy Policy. We rely on approved data transfer mechanisms (such as standard contractual clauses) to ensure your information is subject to adequate safeguards in the recipient country. 3. HOW WE SHARE YOUR PERSONAL DATA

The abovementioned Personal Data is stored on third party hosting providers. We do not sell or loan your personal information to any third parties under any circumstances. Other than as permitted under this Privacy Policy or as otherwise consented to by you or permitted by laws and regulations, we will not transfer your personal data to any other third parties for their processing for any purposes.
We share your information as follows for limited purposes of, including, but not limited to, fulfilling customer orders, offering certain products and services in connection with the Site, communicating to customers, providing customer service, storing, sharing and retrieving customers’ photo images in our Photo Center, enhancing and improving clients’ purchase experience, enabling access to our partners’ web sites, providing a personalized purchase experience and preventing fraud and completing payment method processing:

  1. - With our business partners with whom we jointly offer products or services and brands that work with us.

  2. - When you are a “Creator”, we will provide your Myyshop account information, third-party platform account information, and published content information to merchants for the purpose of matching you with opportunities and accepting the results of your promotions.

  3. - With trusted partners to contact you based on your request to receive such communications, help us perform statistical analysis, or provide customer support. We partner with trusted third parties to provide you with co-marketing content that we think may be relevant to you.

  4. - With service providers that we employ (e.g. other companies and people to provide services to visitors to our Websites, our customers, us and users of the Platform) and who may need some of your information to provide information, products or services to you or us (e.g. IT, system administration, and other services). Examples may include removing repetitive information from prospect lists, analyzing data or performing statistical analysis, providing marketing assistance, processing credit card payments, supplementing the information you provide us in order to provide you with better service, and providing customer service or support.

  5. - With our affiliated companies, companies/entities of MyyShop and our consultants/sales teams.

  6. - With professional consultants and advisors, including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services.• Third parties with whom we may be required to communicate in order to enforce or apply the terms of our agreements; or to protect the rights, property, or safety of MyyShop, our customers, our users or others.

  7. - To the extent necessary, with regulators, courts or competent authorities, to comply with applicable laws, regulations and rules (including, without limitation, federal, state or local laws), and requests of law enforcement, regulatory and other governmental agencies or if required to do so by court order.

  8. - If, in the future, we sell or transfer, or we consider selling or transferring, some or all of our business, shares or assets to a third party, we may disclose your Personal Data to such third party (whether actual or potential) in connection with the foregoing events. In the event that we are acquired by, or merged with, a third party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer, disclose or assign your Personal Data in connection with the foregoing events, including, in connection with, or duringnegotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or to another company.

4. YOUR RIGHTS

You should ensure that all personal information you provide is accurate, complete and up-to-date. In accordance with applicable laws and regulations, we attach great importance to the management of your personal information and make our best efforts to cooperate and defend your rights and interests so that you can fully maintain the privacy and security of your personal information.

You have a right to access Personal Data held about you. Your right of access may normally be exercised free of charge, however we reserve the right to charge an appropriate administrative fee where permitted by applicable law.

You have the right to request the erasure/deletion of your Personal Data (e.g. from our records). Please note that there may be circumstances in which we are required to retain your Personal Data, for example for the establishment, exercise or defense of legal claims.

You have a right to lodge a complaint with your local data protection supervisory authority (i.e., your place of habitual residence, place or work or place of alleged infringement) at any time or before the relevant institutions in your place of residence. We ask that you please attempt to resolve any issues with us before you contact your local supervisory authority and/or relevant institution.
You may exercise the corresponding rights disclosed in this policy and under applicable data protection laws by contacting us by emailing support@myyshop.com , and we will respond to your request within the time limits set by applicable data protection laws . Subject to legal and other permissible considerations, we will make every reasonable effort to honor your request promptly or inform you if we require further information in order to fulfill your request. When processing your request, we may ask you for additional information to confirm your identity and for security purposes, before disclosing the Personal Data requested to you. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive. In the event that your request would adversely affect the rights and freedoms of others (for example, would impact the duty of confidentiality we owe to others) or if we are legally entitled to deal with your request in a different way than initially requested, we will address your request to the maximum extent possible, all in accordance with applicable law. In addition, should you ever decide to delete your account, you may do so by emailing us.
Separately, we may enable or allow you to interact with third-party websites, mobile software applications and products or services that are not owned or controlled by us (each a “Third Party Service”). We are not responsible for the privacy practices or the content of such Third Party Services. Please be aware that Third Party Services can collect Personal Data from you. Accordingly, we encourage you to read the terms and conditions and privacy policies of each Third Party Service. For example, our website may contain links to and from the websites of third parties. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that, to the maximum extent permitted by law, we do not accept any responsibility or liability for these policies. 5. MINORS

MyyShop does not intentionally collect personal information about minors or other persons without full civil conduct capacity, but based on the properties of the Internet, there is no way for MyyShop and the Site to distinguish the age or capacity of the users. By accepting this Privacy Policy through your use or access of the Site, you certify that you are a person over 18 years old (or as otherwise permitted by applicable law to allow you to use the Service without the consent or license of a parent or guardian) with full capacity and ability to form a legally binding contract in the jurisdiction in which you are resident or in which you are entering into this Agreement. If you do not agree to (or cannot comply with) any of the terms of this Agreement, do not use the Site.
Meanwhile, if a minor or other person does not have full civil conduct capacity and has provided personal information to us without the proper consent of their parent or legal guardian, such parent or legal guardian should contact us via the contact details below to remove such personal information.

6. ADVERTISING / DIRECT MARKETING

Except to the extent you have already opted out or in the future opt out, we may also use your personal data for the purpose of sending you direct marketing (whether by messaging within our services, by email or by other means) that offer or advertise our products and services and/or the products and services of selected third parties. Such products and services (of ours or third parties) include the following:

Please note that we will not share your personal data with any advertisers unless you have given us your consent to do so. For the avoidance of doubt, this consent is a separate form and independent of your services registered with us. Accordingly, it can be withdrawn at any time as per this Policy without reference to the duration of the services, and will survive the termination or expiration of any applicable service contracts.

7. GENERAL

We realize that making purchases on the Site, or any other web site, requires trust on your part. We value your trust very highly and pledge to you, our clients, that we will work hard to protect the security and privacy of any personal information you provide to us and that your personal information will only be used as set forth in this Privacy Policy. This includes your name, address, phone number, email address or checking account information, in addition to any other personal information that can be linked to you, personally.
MyyShop may provide links to certain third party web sites. This Privacy Policy applies only to activities conducted and personal information collected on the Site. Other websites may have their own policies regarding privacy and security. We encourage you to review the privacy policies on these sites before you use and access them. You are solely responsible for your use and access of other web sites.
MyyShop will obtain your consent before allowing the download of any software from the Site, and MyyShop will not automatically download any software to your computer system. Once you consent to the initial download of any software, you may receive automatic updates or patches pertaining to such software. You understand and agree that any material, including but not limited to downloaded software, required or automated updates, modifications, reinstallations, or software otherwise obtained through the use of the Site is done at your own discretion and risk and that you will be solely responsible for any damages to your computer system or loss of data that may result from any such material.
MyyShop reserves the right to update or modify this Security and Privacy Policy at any time without prior notice to you. The most current version of the Privacy Policy will govern MyyShop’s use of the information and will always be at . If MyyShop makes a change that, in MyyShop’s sole discretion, is material, MyyShop will notify you via e-mail to the email address associated with your account or other appropriate methods, such as in-app push or pop-ups. Your use of the Site following any such change constitutes your unconditional agreement to follow and be bound by the Privacy Policy as amended.
MyyShop may transfer this Privacy Policy and all or part of its rights, obligations and interests to any party or entity in its sole discretion; however, a user may not assign its rights, obligations and interests under this Policy to any party or entity.
